The Malindi High Court's landmark ruling on the Executive Cabinet is a definitive victory for constitutionalism, born directly out of the historic, Gen Z-led governance movement that demanded uncompromised structural accountability. While the court has handed the Executive a strict 120-day ultimatum to remedy the blatant violation of the two-thirds gender principle, where a mere 7 out of 25 appointees are women, this crisis serves as a damning indictment of both the President and Parliament. By vetting and clearing a fundamentally flawed Cabinet, the Legislature failed its ultimate oversight duty, choosing political convenience over its constitutional mandate to protect the rule of law. The true standard for constitutional fidelity, however, is anchored in the profound dissenting opinion of Justice Jairus Ngaah. As captured in the official judgment record shown in image.png, Justice Ngaah dismantled the legality of the "broad-based" government. He explicitly declared that nominating and appointing members of opposition political parties without formal merger or coalition agreements under the Political Parties Act is a direct "assault on the identification of the Republic of Kenya as a multi-party democracy under Article 4." Justice Ngaah firmly concluded that these appointments violated the Constitution and that the resulting political arrangement has neither a constitutional nor a legal basis. As TISA, we affirm that national governance cannot be reduced to unconstitutional musical chairs designed to insulate the status quo. The civic energy that forced this judicial reckoning will continue to hold both the Executive and Parliament strictly accountable to the letter of the law.

The High Court has delivered a landmark judgment ordering the reconstitution of the Cabinet within 120 days for failing to meet the mandatory two-thirds gender principle. This decisive ruling reinforces the fact that executive authority must always be exercised in strict compliance with Article 27 of the Constitution. Inclusivity is a foundational value of our governance framework that cannot be bypassed for political convenience. The LSK insists on full and immediate executive compliance with this judicial directive to align the Cabinet with our constitutional standards.

We commend ORPP Kenya, with support from NIMD Kenya, for convening a Multi-Stakeholder Dialogue Forum to advance coordinated action on Technology-Facilitated Gender-Based Violence (TFGBV) and Online Violence Against Women in Politics (OVAWP). Our Programmes Lead, Winnie Kimeu, contributed to Panel 2: Digital Infrastructure & Content Moderation Protocols, held under the theme "Securing the Digital Frontier: Assessing Duty-Bearer Preparedness to Curb Electoral TFGBV and OVAWP Ahead of the 2027 General Election." The panel examined platform specific rapid response mechanisms for women candidates, the effectiveness of content moderation in addressing Swahili and localized coded abuse, and the need for stronger coordination between technology companies and local electoral watchdogs. As Kenya prepares for the 2027 General Election, safeguarding digital spaces must remain a shared priority. The dialogue brought together government institutions, regulatory agencies, political parties, civil society organizations, and digital media experts to identify practical interventions that promote safer and more inclusive online political participation. The discussions reinforced a key recommendation from the TFGBV Gap Analysis: effectively addressing electoral TFGBV requires sustained multi-stakeholder collaboration. No single institution can respond to this challenge alone. Lasting solutions depend on coordinated action across government, political parties, technology platforms, civil society, the media, and citizens. Among the priority areas highlighted were: -Strengthening state regulatory oversight through enhanced inter-agency coordination. -Improving digital infrastructure and reporting mechanisms for online harms. -Promoting political party accountability by strengthening internal frameworks to address digital abuse. As we look toward 2027, the time to act is now. Political actors, institutions, development partners, and citizens all have a role in ensuring elections are free from online abuse, intimidation, and digital violence. Yesterday’s High Court judgment in Petition E015 of 2024 is a decisive reminder that the Constitution is not advisory. By declaring President Ruto’s Cabinet unconstitutional for violating the two‑thirds gender rule and granting only 120 days for full compliance, the Court has reaffirmed that Article 27(8) and the gender principle bind the Executive just as they bind every other state organ. The Bench was clear. Tokenism and afterthought appointments cannot cure systemic exclusion. The Court interrogated the composition of the Cabinet, the process of appointment and re‑appointment and the State’s persistent pattern of non‑compliance, and still found the Executive wanting. This is not about rewarding women. It is about enforcing a constitutional architecture that requires no more than two‑thirds of any appointive public body to be of the same gender. Parliament and the Executive have been strange bedfellows in the failure to uphold the two-thirds principle. They appear to be taking the cue from one another on non-compliance. This decision is transformative, as it is a step towards ensuring that the inclusion of women in governance is not performative but a real acknowledgement of their stake in governance, their competence as leaders, and their equal rights as enshrined in the constitution. This moment demands sobriety and statesmanship. If the President treats these 120 days as a window for cosmetic reshuffles or political horse‑trading, he will be in open defiance of a binding court order and of the very Constitution he swore to uphold. Implementing this judgment faithfully is the minimum test of his commitment to the rule of law, women’s equal citizenship, and genuine constitutionalism.

Court Update: Court Victory on Gender Equality in the Cabinet The High Court has ruled that the current Cabinet does not comply with Article 27(8) of the Constitution on the two-thirds gender principle and has directed the President to reconstitute the Cabinet within 120 days to achieve compliance.
