This is a HUGE win. Forced arbitration is a root cause of so much worker exploitation-- misclassification, algorithmic management etc--because workers have no viable way to challenge these structural issues.

Another angle -- since private enforcement can be so much more effective, it matters intensely that employers can evade accountability via #forcedarbitration.

The chasm btwn labor rights in pro-worker & anti-worker states is a huge problem. It leads to a domestic type of "off-shoring" of jobs to places w/ low standards; it allows states w/ poor protections to undercut better conditions elsewhere. A race to the bottom hurts workers!

Today's decision in Bissonnette is, in my view, a major victory for workers whose jobs involve transportation of goods or services. It clarifies that federal law does NOT give their employers the power to force any legal claims (like a wage dispute) into mandatory arbitration.
This is a HUGE win. Forced arbitration is a root cause of so much worker exploitation-- misclassification, algorithmic management etc--because workers have no viable way to challenge these structural issues.

We're still steamed about Lyft's CEO saying Lyft's workers don't need minimum wage laws because the "market" should be setting wages--so steamed @daveyseligman interrupted shoveling recently.
In response to Minneapolis passing a minimum wage for rideshare drivers, Lyft CEO David Risher says people will "stop taking Uber and Lyft" and "it just doesn't work." He says Lyft might avoid the city entirely. A business model that can't pay a living wage shouldn't exist.
Gotta love this totally jacked up arbitration clause posted in a parking lot near the Colorado capitol. Good reminder of (1) the absurdity of contract in modern market & (2) many corporations can immunize themselves from the laws passed in that building through fine-print terms.
Note too that this is just another example of how the companies try to evade responsibility by pushing everything outside the firm. It’s not technically their cars and not technically their employees, but they accomplish everything they need to through coercive contract. /2
These companies love to argue that their drivers are independent in part because they drive their own cars—but turns out, just like so many other of their arguments regarding independence, it’s a sham. The cars always actually belonged to Uber/Lyft. /1
