In decades of reporting on Nazi-looted art and restitution — including my own hunt for a missing Raphael taken by the Nazi governor of occupied Poland — I have never come across a case as legally and morally difficult as the one I write about today. Two lawsuits were filed last week in California under sweeping new state and federal restitution laws. One, against the Norton Simon Museum over a Göring-looted Cranach diptych, seems straightforward. The museum should be ashamed of holding onto it as long as it has. The other is anything but. The daughters of Auschwitz survivor Dina Gottliebova Babbitt are suing the Auschwitz-Birkenau Memorial itself for seven watercolors of Roma prisoners their mother was forced to paint for Nazi Dr. Josef Mengele, on the condition it might spare her and her mother from the gas chamber. I spent the weekend reading the actual complaint. What I found: a Museum that has argued, at different points across six decades, both that Mengele — not Babbitt — owned the paintings, and, now, that she never owned them at all because she was a prisoner. Those aren't the same argument. Congress formally recognized her as the "rightful owner" back in 2001. The Museum still refused to return them. I'm a great admirer of the work this Memorial has done to preserve and educate the world about the horrors of Auschwitz. But this is one matter where I think it has gotten it wrong.
