Late last night, a 2-1 Fifth Circuit panel formally denied Texas’s request to put #SB4 (its controversial new immigration law) back into effect pending appeal: storage.courtlistener.com/recap/gov.usco… Texas can seek en banc review or go to #SCOTUS—or wait for the merits argument next Wednesday.
@steve_vladeck Do we know the merits panel yet or is that same panel that decided the stay?
@steve_vladeck Skimming that this morning. Always impressed by a certain dissenting judge’s uncanny ability to explain 2+2=5 with such remarkable confidence.
@steve_vladeck Appreciate your keeping us informed on the important legal issues of the day sans political commentary.
@steve_vladeck Did the SCOTUS tell the 5th Circuit that its Handmaid’s Tale agenda was moving too fast?
@steve_vladeck In an opinion like this where the court is deciding things that come up regularly, (standing, etc.) how much do they cut and paste from other opinions they've written? Surely every opinion is not entirely original research and writing?
@steve_vladeck I cannot imagine that the drafting of these opinions began after the oral arguments.
@steve_vladeck Help is in El Paso now! Hey illegals, try the shit now!
@steve_vladeck Hmm, I wonder if the recent ruling by the judicial conference on judge shopping and the tone of yesterday's oral arguments played any role...
