@tribelaw How is it that innocent people have died on death row, never getting their cases heard before higher courts and yet this supreme court somehow regularly hears cases with hypothetical harm as the basis of argument?

@sameastheold @tribelaw If they don't hear it, then the decision of the lower Court stands. The SCOTUS has its issues, but there are also big issues in places like the 5th Circuit.
