I write as former Head of Maritime Section of the Foreign and Commonwealth Office and Alternate Head of UK Delegation to the UN Convention on the Law of the Sea Prepcom. 1) The flotilla is on the High Seas and not in Israel's 12 mile territorial sea. Israel has no jurisdiction. 2) The Israeli maritime blockade has been in place for 17 years and is an intrinsic part of the long term occupation found illegal in the ICJ advisory opinion 3) It is therefore not a short term measure in time of armed conflict as specified in the San Remo manual 4) In any event the San Remo rules explicitly state that humanitarian supplies may not be blockaded 5) The UN Commission of Inquiry has already determined that Israel is committing genocide. The blockade is plainly a part of the machinery of such genocide. For reasons 1 to 5 the Israeli attack on the flotilla is plainly illegal. 6) On the High Seas, the law applying on each ship is the law of its flag state. An attack by a state military warship on a vessel on the High Seas is an attack on the flag state of the vessel attacked. 7) Acts of illegal possession of vessels or abduction of crew on the High Seas should be pursued by each flag state as crimes within their domestic jurisdiction, not only in international law. 8) So the Metropolitan Police and DPP have an obligation to investigate and act over the abduction of persons from UK flagged vessels on the High Seas. This applies to each flag state mutatis mutandi. I hope you find this helpful.

Legendary British street artist Banksy has unveiled a new work on the side of the Royal Courts of Justice in London. The mural features a figure holding a blank placard being beaten by a judge wielding a gavel, and comes directly after the Metropolitan Police arrested over 850 people for breaking terror laws on 6 September at a protest against the proscription of non-violent direct action Palestine Action. Approximately 1,500 people took part in the demonstration, organised by Defend Our Juries (DOJ), in London’s Parliament Square - making it one of the biggest acts of mass civil disobedience in British history. Those arrested included former and current NHS staff, an 83-year-old priest and a disabled RAF veteran. A DOJ spokesperson said: “Banksy's work of art on the walls of the Royal Courts of Justice powerfully depicts the brutality unleashed by Yvette Cooper on protestors by proscribing Palestine Action. “When the law is used as a tool to crush civil liberties, it does not extinguish dissent – it strengthens it. As Banksy's artwork shows, the state can try to strip away our civil liberties, but we are too many in number and our resolve to stand against injustice cannot be beaten – our movement against the ban is unstoppable and growing every day. “We hope everyone who is moved by Banksy’s inspiring work of art will join our next action, which will be announced soon.” Since the controversial proscription came into force in July, more than 1,600 people have been arrested under terror legislation and over 70 have been charged. Banksy’s artwork can be viewed on an external wall of the Queen's Building, part of the Royal Courts of Justice complex.

Israel’s genocide is visible from space. The Holocaust was not just a Jewish affair. And not just bc it extended well beyond the attempted extermination of European Jewry. The Holocaust was the great caesura of modern history. To paraphrase Bauman, ‘the light shed by the Holocaust on our knowledge ... is at its most dazzling’ when we fully grasp the modernity of Nazi Germany. When Germany, arguably the most civilized nation on earth, descended into barbarism, it took all of us down with it. The human race itself was sullied simply by bearing witness to the Nazis’ unspeakable crimes. It is quite extraordinary that it is Israel—constructed literally on the basis of the moral claims generated by the Holocaust—that is carrying out a genocide today. That is an insult to the memory of Holocaust twice over. It is as if Japan were using nuclear weapons! Israel has sullied the entire human race, our entire claim to civilization. We have, in fact, descended with Israel into barbarism, just by watching them commit these unspeakable crimes. We are a barbaric civilization. Now I am beginning to comprehend why Stefan Zweig and his wife committed suicide in 1942. It was not so much that they expect the Reich to last a thousand years. It was rather that they did not wish to live in such a monstrous world. Just breathing the air felt like a crime.
