I hate depositions where the lawyer asks 6 1/2 hours of pointless questions just because she can: no theme, no focus in getting evidence for an MSJ or CX at trial. Total timewaster. #trademarks #trademark #trademarklaw

I defeated a motion for judgment on the pleadings today. The Judge was ready to grant it but I kept working on her until she eventually agreed with me. Opposing counsel was unhappy. #trademarks #trademark #trademarklaw

Shoot me. I agreed to extend the discovery schedule 4 times. The excuses were always the same. I refused 5. They freaked out. Motion to extend; and they want me sanctioned because I would not agree after the case was suspended to schedule a depo of my client. Seriously? #TTAB

Discovery is easily abused. It is so easy for lawyers to lie, obfuscate, and be uncooperative -- in part because Judges hate motions to compel. I hate that. My view is: be an adult & give them what they want. Fight over the merits. #trademarks #trademarklaw #TTAB #trademark

I learned early-on that you go into deposition w/a plan; what you want to get for your case. Today's 4-hour snore-fest was a good example of a mechanical deposition by Big Law. They got zippo from my witness and were pretty frustrated. #trademarklaw #trademarks #tardemark

Settled a stupid case today. The trick was to find a way to have plaintiff save face w/o burdening my client. After receiving the draft K my client was prepared to go to war. Hard work to turn that around but everyone is happy with the deal. #trademarks #trademark #trademarklaw

Big Law says getting formula approval for a whisky & trying to find distributors is use analogous. I am just a small town lawyer but I don't see how that creates brand identification with consumers. #trademarks #trademarklaw #trademark #winelaw
