On Thursday, the @FCC will consider its draft net neutrality rule. I commend the FCC for this step. However, the current version of the rule contains a big loophole that will undermine CA’s nation-leading net neutrality law, SB 822, which I authored. Here’s my letter to the FCC:

California’s net neutrality law explicitly prohibits fast lanes. The FCC should not undermine this critical protection by authorizing fast lanes in its rule. There is no difference between speeding up and slowing down favored apps. Both violate net neutrality principles.
Net neutrality is the foundation of an open internet. FCC’s draft rule prohibits companies from slowing down apps or classes of apps but says nothing about speeding them up. That’s a loophole that will allow ISPs to create “fast lanes” for favored companies to get faster service.
On Thursday, the @FCC will consider its draft net neutrality rule. I commend the FCC for this step. However, the current version of the rule contains a big loophole that will undermine CA’s nation-leading net neutrality law, SB 822, which I authored. Here’s my letter to the FCC:

The European Commission has been contemplating radical changes to the Internet in Europe that would violate #netneutrality and upend how the internet economy has worked for decades. Its proposal: the long-discredited idea that websites and apps should pay broadband providers.
The letter urges the Commission to quickly publish its review of the Broadband Cost Reduction Directive and calls for a separate, open & transparent debate on ETNO's #NetworkFees proposal. The letter was sent by Austria, Estonia, Finland, Germany, Ireland & the Netherlands.

@wendyndavis @KarlBode To use an analogy, it is like going from a dedicated medical specialist to an overworked general practitioner. You are still getting medical care, but it ain't the same, and pretending it's as good or better is just false.
@wendyndavis @KarlBode So to summarize. ADPPA protects less of your telephone info as sensitive. It does it less well. It moves from a specialized enforcer that has generally done a good job on phone privacy to an overworked, general enforcer with fewer tools and weaker powers.
@KarlBode Cutting the FCC out of policing phone privacy -- with its implication for everything from law enforcement abuse to competition to public safety -- isn't some little snip. it is a fundamental change that is happening on the fly on a statute designed for tech companies.

The federal privacy bill #ADDPA guts the FCC's authority to protect people's phone privacy. That's a problem. As @haroldfeld explains in this thread, carriers have data that's much more detailed & sensitive & the FCC has stronger tools to protect it than the FTC under the ADDPA⬇️
@vanschewick I think one of the things often lost in this is the huge difference between what aps collect, which is simply GPS data, and what carriers collect, which is A-GPS data, in addition to metadata carriers have that aps just don't, like numbers called.
The FCC's investigation into mobile carriers' geolocation data policies is a powerful reminder that the FCC already has the authority to protect the privacy of mobile phone customers under §222. The federal privacy bill #ADDPA negotiated in Congress would eliminate this authority
FCC is investigating mobile carriers' policies on geolocation data - what geolocation data they collect, how long its kept & whether it's shared with law enforcement & others. So much can be learned from knowing where we are throughout the day. Glad the FCC is looking into this.
