Jeff is a smart man but this is a miserable take. You get what you pay for and the industry standard is 20% on marketing deals. This has been true for decades. Good luck finding a reputable agent who is willing to take a discount. Sure, some very marketable players have leverage and can negotiate a smaller commission with top tier agents. However, most people have no appreciation for how much work marketing agents perform without any guarantee of ever earning a fee. Very few players command top dollar on marketing deals. To clarify, all of the above is separate and apart from NIL collective deals, which should not fall within the scope of a Marketing Agreement definition in an agent representation agreement.

@DarrenHeitner the athlete(s) always end up regretting it and you can make up the agent fees because on average they get them higher payouts.
@DarrenHeitner Collusive price fixing, you say.
@DarrenHeitner we do 15% of Marketing deals👌
@DarrenHeitner @CoachHouston4 @DerekLagway1 control your own content and communication at all levels
@DarrenHeitner You’re a a lawyer. What’s % of NIL deals that you’ve seen are from a collective/a donor vs anything else?
@DarrenHeitner Everyone is allowed to work hard and earn money except agents it seems…
@DarrenHeitner Give it a few yrs - there will be a line from NYC to LA full of agents who need clients & willing to take a lot less.
@DarrenHeitner Call it what you want but players signing most deals with collectives are not true “marketing deals” There is no value add for the collective entity. It’s not their intent. We at @HunterAthletes educate and advise players & families that 20% is a ridiculous commission rate.
@DarrenHeitner 20% on collective is nuts 20% on marketing deals is standard
@DarrenHeitner It’s been my experience that this is highly negotiable. My two cents.
