Proof of Ownership Certificate: Understanding the law & issues: There is a body known as JOINT TAX BOARD (JTB). The Board is established by Section 86 (1) of the Personal Income Tax Act Cap. P8 LFN 2004. The Board membership are: Chairman FIRS, 36states members nominated by the Gov. Co-opted members are: FRSC, RMAFC, 25% FCT, FMOF, FIRS. Federal Road Safety Commission (FRSC) in line with Section 5 of their Act must issue NATIONAL ROAD TRAFFIC REGULATIONS. This regulation was issued in 2012 & was GAZETTED after the approval of JTB. The regulation came into effect on 13 August,2012 ( I repeat, 2012). There was another amendment in 2016 that amended 41 regulations & 3 schedules. It does not replace 2012 rather an amendment. Joint Tax Board on May 9, 2023 approved N1,000 annually to give effect to the powers of FRSC. This will minimize car theft, recovery of stolen vehicles, central database for verification of vehicles. This is also in with FRSC Act 2007. Then, Court of Appeal in Calabar has upheld the powers of the FRSC to impose fine. What is the issue? 1: The law was enacted in 2007 by NATIONAL ASSEMBLY for FRSC. JOINT TAX BOARD approved & gazetted on 13 August,2012. 3: JTB in exercising their power approved the implementation nationwide on May 9,2023. Hope you have understood the law? FRSC can act alone by their law and does not need President/Gov’s approval. They will pay each 36states & 25% FCT their shares accordingly. A concerned Citizen or the other guy at calabar can approach the Supreme Court to seek interpretation. Don’t forget COA fined him N50,000 and he will still pay outstanding FRSC fines. @woye1 If we must tell ourselves the truth, Federal government has no business meddling in vehicle registration or ownership certificate of any sort. These are things that the state and local government should be dealing with. We can’t continue to depend on Abuja for everything.
