ALLOW me to stay on the @WilliamsRuto topic for a while. Mr President you are misleading Kenyans. No court has stopped you from building "affordable" houses. You are free to build a million of them. You are free to employ a million youths on those sites. You are free to then sell the houses at a profit. The issue in court is not about building houses, its about TAXING Kenyans to build those houses. Number two, even on the issue of taxing (Housing Levy), no court has stopped you from carrying on with it. Infact NO JUDGE would be bribed to stop you from taxing. Its not personal. Its non of their business. All what the judges said is that its unconstitutional, illegal null and void. And they closed their pens and went golfing. Once a judge has declared anything unconstitutional, he moves on to other things. He will not come to State House to tell you what he has ruled. Its the business of your government to obey or disregard the orders. By the way, the orders are never directed to the President. It must be to the AG. I wish the AG can brief Kenyans about these cases, he is the best suited. By the way do we have an AG? And Mr President, we also read the constitution we know about economic rights. The issue was strictly on taxing Kenyans. Don't tell Kenyans that their courts have no right to decide whether they are legally or illegally taxed. A judge of the High Court has over 50 cases to deal with. Stop making Kenyans think that Housing Levy and the Healthcare cases are the only cases in courts.

Recently, a magistrate somewhere in Kenya was hearing a criminal case involving a fairly senior Kenyan. After the conclusion of the prosecution, a no case to answer was argued by the defence and prosecution under section 210 of the Criminal Prosecution Code. The magistrate reserved his ruling. The magistrate and the accused then met. A bribe of kshs. 5 million was negotiated and given to the magistrate to acquit the accused under section 210. The accused's successor in office heard of the arrangement. He met the magistrate. They negotiated a bribe of kshs. 10 million. The accused's successor in office told the magistrate to refund the accused his Kshs 5 million, rule that the accused has a case to answer and then put him on his defense. The magistrate received Kshs 10 million. In the morning, when the ruling was to be delivered, the magistrate called the accused to chambers. He gave him back his 5 million shillings and told him not to worry. "I will help you. The prosecution's evidence is weak. I will not take advantage of your situation. I will deliver the ruling at 2.30 and acquit you under section 210". At 2.30, the magistrate delivered the ruling. He held that prosecution evidence is strong and the accused has a case to answer. He then put him on his defense. Moral of this court case?. These games are now the norm in Kenya at ALL LEVELS of the judiciary...Why? Because CJ KOOME and the Judicial Service Commission have adopted a policy decision that any complaint against judge/magistrate that touch on his judgment be dismissed because "judges/magistrate exercise DECISIONAL INDEPENDENCE and entertaining such a complaint interfers with the INDEPENDENCE of the JUDICIARY"...that is why since KOOME assumed office not a single judge was removed from office... rampant corruption and the deluge of complaint to the JSC notwithstanding...THE JUDICIARY IS BROKEN...AND NO ONE CARES TO FIX... @Kenyajudiciary
