@heitner @SportsAgentBlog This isn’t unions selling out. Unregulated NIL built a feeder system with huge money but no health coverage and no agent regulation. They backed the parts guaranteeing NIL rights, medical benefits, and agent caps. They want players reaching the league protected, not fleeced.

@heitner The state-by-state injunctions you’re cheering are exactly why there’s no uniformity. Fifty courts can’t manufacture one standard. Asking Congress for a single rule isn’t begging, it’s the only thing that actually fixes the patchwork.

@heitner Uniform enforcement of a four-season clock means nobody gets the bonus JUCO year, not everybody does. You’re using the language of consistency to argue for expanding a carve-out. And these wins are antitrust rulings overriding NCAA rules, not the NCAA being held to its own.

Athletes, the Sorsby case is a warning. NCAA rules don't just ban betting on your own games. They can cost your eligibility for wagering on any sport the NCAA sponsors, even through someone else's account. Assume every bet is traceable, because it is. Safest play: don't bet.

@PeteNakos Two issues here. NCAA and conference rules get rule-of-reason review, not per se (Bd. of Regents, Alston), so 'per se' is a stretch. The injunction also binds only the NCAA. A nonparty is bound only if it acts in concert to evade the order, not when enforcing its own bylaws.

@On3 @PeteNakos A conference enforcing its own bylaws against a member isn't a naked horizontal conspiracy. Antitrust protects competition, not one competitor. Tortious interference is tough when the bylaws permit the sanction. And $200M assumes a rule-of-reason loss that's far from given.

@AlbertBreer And the case was never about whether he broke the betting rule. He admits he did. So "the rule is black and white" doesn't touch the claims he actually brought. Those get decided at the 2027 trial, and the NCAA can still appeal the order.

@AlbertBreer Small thing, but Texas TI practice doesn't use the federal "likelihood of success" test. The applicant shows a probable right to relief plus irreparable harm. The judge found that on the contract and fiduciary-duty claims against the NCAA, not that Sorsby wins.

The loudest Tech-defender take is that the Big 12 is "bound" by the Sorsby order and can't act. That's a stretch. "Active concert or participation" reaches agents and abettors of the enjoined party, not an independent conference enforcing its own bylaws. #SportsLaw #CFB

Texas Tech gets its 2026 QB and moves on. The NFL doesn’t forget. Front offices see the lawsuits, the gambling-rule fight, the contempt threats, and think about their locker room and their PR. Teams don’t draft problems they’ll have to manage. Sorsby’s becoming one to manage.

@PeteNakos The tell is in the ‘or’: Kessler pleads a boycott ‘of Texas Tech OR of Mr. Sorsby.’ Sanction the school under 3.6 and the injury runs to Tech, not Sorsby. His standing is cleanest as the injunction’s beneficiary moving for contempt, weakest suing in antitrust over harm to TTU.

@chris_kratovil @CodyC64 Respectfully, fellow litigator here, & I think this overstates the order’s reach. TI binds the NCAA, the only def. The Big12, CFP, and other schools aren’t parties & aren’t acting in concert with it, so each keeps its own discretion under its own bylaws.
