🚨 The High Court ordered Karen Hospital to release the body of a patient that was held for 67 days over an unpaid Sh2.4 million medical bill, stating that the dead are not collateral. The case concerned Justin Mwangi, who died at Karen Hospital in May 2026 leaving a bill of about Sh4 million. The Social Health Authority paid part, and the family and well-wishers raised Sh1.1 million more, but a Sh2.4 million balance remained. His body was moved to a funeral home and effectively held there for 67 days while the debt was disputed. His relative went to the High Court, and Justice Anne Okutoyi ordered the unconditional release of the remains. The settled legal principles: First, dignity. Article 28 of the Constitution guarantees every person inherent dignity, and the courts have repeatedly held that this extends to the dead and to their bereaved families. The court noted that delayed burial wounds the dignity of the deceased, the emotional wellbeing of relatives, and their cultural and religious obligations. Second, there is no property in a dead body. This is a long-established principle: a corpse cannot be owned, and therefore cannot be held as security or collateral for a debt. A hospital has no lien over human remains. Third, debts must be recovered lawfully. A hospital’s right to be paid is real, and the law gives it proper avenues, a civil suit, a demand, ordinary debt-recovery mechanisms. What it does not permit is detaining a body to coerce payment. As the court put it, the detention of a corpse is not among the options the law envisages for recovering a debt. A landmark 2025 High Court ruling already declared the detention of bodies over bills unconstitutional, the medical regulator has warned hospitals against it, and Parliament is considering a bill to outlaw it outright. Yet families keep being forced to court to bury their dead.
