This is 100% correct. Nick did a lot of work on behalf of this issue that he's not going to get credit for because the work ended up in other cases before his own. We spent much time talking through these issues, but he was way ahead of me because I was late coming to this defense work. Nick did a lot of the heavy lifting early on -- as well as Dave Fischer (no relation) on behalf of Thomas Caldwell in the Oath Keeper case. Many defense attorneys -- including me -- borrowed heavily from the arguments fashioned by Nick in our filings in other cases. I gave him credit two nights ago in a Spaces session. I'm glad Tim pointed it out again here. The attorneys who especially DID NOT advance the ball on this argument were Jake Lang's attorneys. Their work was not close to what Nick did. Lang's charge was dismissed not because of their work, but because Judge Nichols dismissed the 1512 count in Garrett Miller's case. The Lang and Fischer dismissals happened only because once Judge Nichols dismissed it in one case, he was going to dismiss it in all cases before him where it was charged. That is how it was dismissed in Lang's case. DO NOT FALL FOR LANG'S CLAIM that his attorneys or the funds Lang has raised grifting off this issue had any impact on what happened today in SCOTUS.
