THEY WON’T DEFEND IT: Michigan Secretary of State Jocelyn Benson created a new rule ordering clerks to destroy election records. My client sued because it forces her to break federal law. Benson filed twenty-three pages trying to get the case thrown out, and NOT ONE ARGUMENT to say her rule is legal. Read it yourself. Their brief tells the court that their own Director of Elections “cannot offer a substantive argument in response to Plaintiff’s complaint without tipping his hand.” And this: "it remains to be seen whether Defendants will have the same legal position regarding the rule." They have previously argued that the rule violates no law, including the federal statute. They just won’t say it to a judge here in Michigan. So what did they try to argue? That she WAITED TOO LONG, in a case filed EIGHT DAYS after the election, after asking them TWICE to clarify the rule, the first time last fall. That any determination about Benson’s rule belongs in a “process” run by the department my client sued. Never once in twenty-three pages did Benson argue a clerk can DESTROY federal election records in seven days when federal law says KEEP them twenty-two months. That is the ENTIRE CASE. Twenty-three pages from Benson on why a judge shouldn’t answer this important legal question, and NOTHING on what the answer is. Our response went in yesterday afternoon to the judge. The RNC filed an amicus brief as well. And their own sworn affidavit says they still want to send election record destruction “guidance” to Michigan's 1,500 local clerks later this week. Let me explain the technical problem for US/Canada/Mexico trade and why this trade dispute is so consequential. NAFTA 2.0 essentially treats North America as one giant market. Not absolutely but lots of benefits afforded to counter parts inside not afforded to countries outside. China recognizes the US has become much more restrictive on trade with China. So China says, I can still get the benefit of trade with the US by routing my trade through Mexico or Canada. Oddly enough, the US is saying to Mexico and Canada, we want the assurance that when we buy a product that says Made in Mexico it is made in Mexico with as many non-Chinese parts as possible, by non-Chinese workers, and by non-Chinese firms. It's kind of amazing that Canada objects to that idea. What is notable is that Mexico has actually cooperated with the United States on these trade issues. This is not to say they are perfect no country is, even the US is not, but Mexico has decided very clearly its interests are best served by blocking Chinese activities like trans-shipment. US-Mexican trade is booming. Conversely, Canada is actively undermining US interests by signing deals with Beijing and rejecting American requests to block and take actions on things like trans-shipment, high risk imports, and money laundering just to name a few. You can rail against the US and Trump all you want but the basic requests are not burdensome or anything draconian. If Canada really wants to align itself as the conduit for Beijing into the North American market, that is your sovereign right to pursue that course of action. It is also the US sovereign right to say we disagree with that and will not bind ourselves to your agreements with Communist China. Sorry not sorry

Since April 2020, the United States has spent $1.5 trillion on wind and solar. All that money for just 17% of the nation's energy mix. For the same cost, America could have built around 40 nuclear power plants. They'd run for 80 years, not 15 or 20 like wind and solar, and would generate at least three times more power each year. By 2028, estimates show that the US will spend ~$5 billion per day on interest, more than any other category. To put this into perspective, the US now spends $3.1 billion per day on Medicare and $2.5 billion per day on defense. When the cost of your debt becomes your biggest outlay, you know something is broken. Intervention by the US Treasury is only a short-term "solution."
