The view (which I share!) that Ukraine is fighting a just and necessary war of self defense against aggression--and the more implicit view that Russian civilians have been complicit in aggression--seems very much to be influencing the level of interest in the law of armed conflict.
The New York Times ran another story recently inquiring into the legality of strikes in Iran on dual-use facilities. This has been a recurring area of interest for major Western media outlets. nytimes.com/2026/07/11/wor…
Mamdani's refusal to back off this idea strikes me as both dishonest legally and institutionally reckless, given the confrontation between local and federal authority that it would create.
I just do not see colorable arguments that New York City police arresting Netanyahu would be either required by international law (given that US is not an ICC member); or permissible under US law (given the primacy of the federal government in international relations).

@stavridisj But worth noting that the trajectory since WWII has been toward greater state control of the ocean, through expanded territorial seas and the exclusive economic zone, in particular. The pressure on freedom of the seas has been building for decades.
@sevslv It just seems like a real reach to say that non-members who believe a court is misconceived and which it has no plans to join have some kind of obligation to that court's officials.

I guess my view is that most states--but particularly major powers--are only episodically rule-of-law states particularly when it comes to national security issues. See, eg, the Kosovo intervention when most of NATO went to war in contravention of the UN Charter. Most major powers have also imposed serious limitations on ICJ jurisdiction over national security, etc etc.

@sevslv As a non-party, the US has no obligation to respect the judicial and prosecutorial independence of the court. As for pressuring states to leave the court, that seems to fall more in the realm of diplomacy (absent a threat to use force).

@sevslv Under ICC jurisdiction, yes, the US clearly objects. But does the US actually claim that states cannot themselves exercise jurisdiction over US nationals on their territory?
@EVKontorovich @dansenor I think the ICC asserting jurisdiction over non-member state nationals is a mistake, but it's unfortunate that it's not possible to deal with that issue without presenting a caricature of the court.

@MarkLGoldberg But it has investigated American personnel and indicted the head of state and defense minister of a close US ally.
@ASDylanJohnson The only ICC investigation that we know of that scrutinized conduct by US personnel was in Afghanistan, and one of the first moves by the current prosecutor was to shelve the US portion of that investigation and focus on crimes by the Taliban.
