HAPPENING NOW: Former acting Attorney General Jeff ROSEN is testifying at Jeff Clark's bar discipline trial. Yesterday: politico.com/news/2024/03/2…
ROSEN says in hindsight Jeff Clark was not forthcoming when they first discussed his letter recommending that Georgia legislators revisit the results of the 2020 election. "He indicated to us these were his ideas," Rosen recalled.
ROSEN said he had lunch with Pat Cipollone on Dec. 29, 2020 and told him that Jeff Clark had met with Trump without telling him. Cipollone told him that the Trump-Clark meeting "was totally news to him" and "he was unhappy about it."
MORE: Jeff Rosen, describing lengthy Jan. 3, 2021 call w/ Clark: "I expressed disappointment in him. I told him I thought he was making a colossal mistake. He shared his perspective that he was disappointed in me…the long and short is he said he was going to take the position."
Cross-exmaination underway. CLARK'S ATTORNEY: Mr. Clark had a different view than yourself as to what the department’s posture ought to be in the election controversies? ROSEN: Yes, unfortunately his wasn’t based on the facts and the law.
ROSEN is off the stand, investigators are preparing to rest their case but planning to call Jeff CLARK, who they expect to plead the Fifth on a question by question basis. Clark's lawyers are arguing against forcing him to take the stand just to assert the Fifth.
HAPPENING NOW: Disciplinary counsel have called Jeff CLARK to the stand, and he's expected to plead the Fifth on a question by question basis.
CLARK is now on the stand and is pleading many privileges: Fifth Amendment, law enforcement, deliberative process, attorney-client and executive privilege,
As Clark continues to assert these privileges, he jokes: "A veritable phalanx of privileges."
