The law must apply equally to every Australian! #NativeTitle shouldn’t become a licence to ignore Australian law. That principle will be tested when the High Court hears Redland City Council v Burns next Tuesday. The case began in 2020 when an Elder and QYAC ‘Land and Sea manager’, Mr Burns, arranged for an excavator to clear about 2,400 square metres of protected vegetation on State land at Point Lookout. Mr Burns was found guilty in the Magistrates Court of illegally clearing protected land. That conviction was later overturned by the District Court, which accepted that he honestly believed traditional rights allowed him to clear the land. The Queensland Court of Appeal then rejected Redland City Council’s attempt to reinstate the conviction. Council has now taken the case to the High Court. It argues that a mistaken belief about Native Title rights should not excuse someone from complying with Queensland’s planning laws. The High Court must now decide whether Mr Burns’ belief provides him with a valid legal defence. The purpose of Native Title was to recognise traditional rights and interests within the Australian legal system. It was never meant to create a separate class of Australians to which different laws apply. Yet that is where this argument risks taking us. If a person can rely on a personal belief about Native Title rights that were never actually recognised, governments and regulators will face enormous difficulty enforcing any planning, environmental and land management laws. Australia must not drift towards an American style patchwork of quasi sovereign enclaves, where separate authorities enforce different rules based on a person’s ancestry or the land they occupy. We should have only one system of law in this country. This case is even more important because of the ongoing Native Title claim covering large parts of the Redlands mainland and bay islands. That claim is legally separate. However, the High Court’s interpretation could have broader consequences for future disputes involving planning, environmental and land management laws. Native title rights must be clearly defined, properly established and applied consistently within Australian law. There cannot be one law for some Australians and another law for everyone else.
