Kenneth Espinoza has reached a significant settlement of $1.5 million with Las Animas County and other parties, following an incident two years ago where he was subjected to excessive force by law enforcement officers. The settlement, announced by Espinoza's attorney, Kevin Mehr, marks the culmination of a distressing episode that occurred on November 29, 2022, where Espinoza was repeatedly shocked with a Taser in the face while handcuffed, during a forceful arrest executed by two sheriff’s deputies. This incident not only led to the firing of the deputy and lieutenant involved , after an investigation revealed inconsistencies between the body camera footage and the officers' accounts of the arrest, but it has also ignited a broader conversation about police accountability. "This settlement is not only a victory for Mr. Espinoza and his family,” Mehr stated. “It’s a victory for the people of Colorado and sends a clear message to those who misuse their badge for brutality, signaling an end to such misconduct. If the sheriff won’t hold you accountable, we will." The events leading up to this lawsuit began when Espinoza and his son, Nathaniel, were in Trinidad for construction work. They were en route to a local Ford dealership to drop off a pick-up truck for service, with Nathaniel following in a separate vehicle. It was during this journey that former Deputy Mikhail Noel initiated a traffic stop on Nathaniel, prompting Kenneth to park his truck close by to stay near his son. This action led to a heated confrontation with Lt. Henry Trujillo, who had arrived as backup. Body camera footage revealed Trujillo aggressively ordering Espinoza to leave, followed by a confusing exchange where Espinoza received conflicting commands, ultimately leading to his wrongful detention. Espinoza, attempting to comply with the deputies' instructions, found himself at gunpoint, handcuffed, and subjected to Tasers being deployed by Trujillo and Noel, with one Taser striking him in the face. It was reported that the deputies used their Tasers approximately 35 times on Espinoza. The ordeal did not end there; despite Espinoza's peaceful cooperation and evident distress, he was threatened further and taken to jail under conditions that were not justified. This case was brought to light not just through the initial investigative efforts by the Las Animas County Sheriff’s Office but was further substantiated by an independent investigation conducted by the Pueblo County Sheriff’s Office. The findings of this investigation were damning, highlighting that there was no cause for Espinoza's arrest, that the use of Tasers was misapplied, and that the subsequent reports filed by the deputies were misleading.

There was absolutely no reason for that man to pull up behind a marked police car with flashing lights in the middle of a traffic stop. In fact, it’s unlawful to stop on most major highways. Cooler heads would’ve prevailed but the officer was very polite during the initial approach. He gave the driver many opportunities to leave but the driver’s ego prevented him from doing so.
