🦔Apple is suing OpenAI for systematic trade secret theft weeks before the IPO. The complaint alleges a former Apple engineer exploited a bug to access Apple's cloud storage while employed at OpenAI and laughed about it in a text message. Tang Tan, now OpenAI's chief hardware officer, allegedly used Apple codenames in interviews to extract confidential information from current employees and circulated an internal Apple offboarding doc to teach new hires how to dodge exit security. Over 400 former Apple employees now work at OpenAI. My Take If even half of this complaint holds up, OpenAI's hardware plans are finished. You can't ship a device when a court has ruled your team and supply chain were built on stolen IP. Apple has more cash than most countries and a legal team that treats intellectual property enforcement like a religion. This is about the worst opponent OpenAI could have drawn right before asking public markets for money. The bigger problem is what this says about the company. Apple isn't describing one rogue employee. They're describing a senior hire who allegedly coached recruits on bypassing exit security and an engineer who treated accessing his former employer's files like a joke. Ten companies are now 43% of the S&P 500. The 250 smallest companies in the index? 8%. Combined. Read that again. Half the index, by count, weighs less than one fifth of the top ten. In 2014, the top 10 were 18% and the bottom 250 were 14%. Nearly balanced. Twelve years later, the gap has never been wider in the data. This is what "buying the index" means now: a quarter of every dollar goes into two companies' worth of names, and the S&P 500 has quietly become the S&P 10, with 490 passengers. Diversification was the entire promise of indexing. Concentration is what it delivers at the top of every era. 1929, 1972, 2000. A Slower AI Payoff Would Be Everyone's Problem "Consensus expects free cash flow for the hyperscalers to more than double over the coming years, see the first chart below. But what if the payoff takes longer than consensus assumes? That question is particularly pressing given that token prices continue to decline and Chinese models are gaining ground, both in their share of the world's most-used models and in token usage, where they now lead their US counterparts among the top 20 models, see the second and third charts. If Chinese models keep gaining and token prices keep falling, the hyperscaler cash flows expected may prove too optimistic. What are the consequences if the AI payoff comes slower than expected in the first chart? 1. Cash flows and earnings disappoint: the projected free cash flow surge slips later while committed capex and heavy depreciation hit on schedule, squeezing margins and marking down the forecast in the first chart. 2. A Mag 7 sell-off that takes the market with it: equity prices built on a fast payoff re-rate, and because the Magnificent 7 now account for so much of the indices, the pain can't stay contained, it spreads to chips, power, data centers and the S&P 500 as a whole. 3. Balance sheets stretch and credit risk rises: with internal cash unable to cover spending, hyperscalers lean further on debt, raising leverage and inviting possible ratings downgrades if profits lag. The bottom line is that AI has been the one thing holding up both the economy and markets, and with so much riding on so few names, a slower payoff wouldn't just be a sector problem, it would risk tipping the economy into recession and the S&P 500 into a correction." all courtesy Apollo/Slok

Datacenter construction growth is slowing

Remember when Trump said: "Gasoline retailers must get their prices down, IMMEDIATELY." The US is subsidizing oil consumption by: - Creating fake stories. - Depleting inventories. It has worked incredibly well so far... But inventories are finite. Once tank bottoms are reached, no amount of fakery will keep oil prices from rising.

The most important chart in tech right now. Free cash flow of the hyperscalers (Amazon, Google, Meta, Microsoft, Oracle) just went negative. Below zero. For the first time in the dataset. Meanwhile, semiconductor FCF (Nvidia, Micron, Broadcom, AMAT) exploded to over $400 billion. For fifteen years, the hyperscalers were the greatest cash machines capitalism ever built. Asset-light platforms printing $250 billion a year. That was the entire bull case: software eats the world, and the cash flows to whoever owns the platform. The AI buildout inverted it. The platforms are now pouring every dollar, and then some, into chips and data centers. The cash didn't disappear. It transferred, straight down the supply chain to the shovel makers. Here's what history says about both ends of this chart: The buyers: companies that burn cash on capex booms rarely earn back their cost of capital. Telecoms, 1999. Shale, 2014. The sellers: supplier windfalls at the top of a capex cycle are peak earnings, not new baselines. The customers' spending discipline eventually returns. Ask Cisco. A generational transfer of cash flow is a generational transfer of risk. Both lines on this chart are priced as if only the good half is true.

Russian refinery throughput has now collapsed to 2.8mbpd from 5.1mbpd in 2022. Omsk is severely damaged, though not yet fully offline (see below). Gasoline, diesel and jet shortages are now emerging simultaneously. With multiple crude distillation units (CDUs) knocked out across the refinery system, there is no quick path to restoring refining capacity. Sustained product imports are becoming Russia's only viable medium-term solution. Good luck with that. Belarus' Mozyr refinery is the Kremlin's best hope for securing up to 90kbpd of gasoline and a bit of jet and diesel.
