In April 2025, the BOP capped Second Chance Act placement at 60 days. The statute allows up to 12 months. It requires individualized determinations. No APA rulemaking. Just a memo. The Supreme Court recognizes the Rule of Lenity — when a criminal law is ambiguous, it should be interpreted in favor of liberty. So why does BOP interpretation so often lean toward restriction instead?
