My previous email dated Feb 01, and Feb 05 urged an appeal of the January 30, 2026, verdict (acquittal on first-degree murder). No response has been received.
Over 5 years, a clear pattern exists: I have repeatedly conveyed views, evidence, and concerns in discussions/emails, yet not once has any of my contributions been considered or reflected in decisions. This goes beyond non-communication—it's a complete failure to consider victim input, disrespecting my rights and prolonging our pain. The appeal window closes ~March 1, 2026. Grounds for appeal are overwhelmingly strong for first-degree murder, directly countering the judge's flawed assessment of no specific intent. Key evidence includes:
Two Stab Wounds Indicating Greater Intent and Force: Forensic reports and testimony confirm two deliberate, forceful stabs (one piercing the spine front-to-back, another through the arm hitting bone and severing muscle). This occurred in close pursuit, with Montana chasing Sammy and Semiah, stabbing face-to-face as Sammy tried to block—aligning with premeditation, not a single unintended act. Sammy died almost instantly from massive blood loss.
Premeditation via Texts: Montana's messages (e.g., “I’m going to kill Sam — today’s the day”) and luring texts to bring them back to the house show planning and vengeful intent. Well at the same tiem telling his friend he is going to kill Sammy. These are facts we all no all documented as truth
Testimony Inconsistencies and Lies: Montana's accounts and stores were rejected as not credible (e.g., self-defense claims), yet the judge selectively accepted uncorroborated parts. And know perjury charges and the lies stacked up lie after lie. But of course, nothing . Semiah's consistent, credible testimony contradicts this—Montana lied in front of the court about key events.
Absolutely No Evidence of Intoxication: No corroboration from any officer, jail guards, Montana himself that day, Semiah, or tests—directly undermining the judge's crediting of unsubstantiated claims of drug/alcohol influence.
Zero Evidence of Horrorified or Remorse—Semiah was horrified if you heard the 911 call and her testimony. Exact Opposite Provenin court with all the evident we all have and seen to gethere all documented: Montana showed no remorse for murdering my son or our family's pain—ever, in front of us or in court. This is the truth we all witnessed and cannot avoid. Officer testimony (e.g., off-duty neighbor hearing yells, seeing Montana not helping but standing in the front yard), Semiah's account (pulling Montana off of Sammy after she seen the knife on the drive once Sammy and Montana fell on the ground, she noted she grab the knife and throught it so Montana wouldn’t stab Sammy any more, no aid from Montana what so ever no help for my son), and his own actions (apologizing only to Semiah because he yelled at here, calling others to say he's "going away for a long time," merely pointing to the general crime scene for police without active help ) this all clearly proves the opposite of remorse. The knife was lost in struggle, not dropped intentionally.
Additional Documented Points Proving Premeditation and Intent: There are many such points, all documented in the system but I will just point out a few (hospital records, police videos, trial testimony), and they will come out word-for-word exactly as I am stating here today. For example: Semiah attempted to take her own life (Maybe this would have been import and even import that Montana hated my son immediately but we all new that I told you guys that from day one) because of her brother Montana's actions and issues—not because of Sammy . I informed the Crown of this information early on, but it was never brought out or addressed in court. This occurred in the first 6 months of Semiah and Sammy's relationship; the problems and conflict were always with Montana, never Sammy. The issue was far before my innocent son came into there life. This is fully documented in hospital record , if anyone had chosen to look, it would have been clear. As well documented conversation on social media stating all this information as well. I always thought it was funny how the scope was so small for a murder case . You would think they would stat that they can go back years if they must. Once again you would have seen the plan in the works. But even with out this information his action that day show planned and premeditated .
Other examples Semiah testified that Montana was discussing manslaughter with Sammy that day and had him look it up online—not murder right?. Then, after he murdered my son, in jail (captured on police video that we all saw), when officers told Montana he would be charged with first-degree murder, Montana leaned back in his chair with his hands behind his head and stated, “I thought it would be manslaughter.” This is blatant evidence of premeditated murder—he expected a lesser charge because he tried to plan it this way when he was lying to them about what happed this first time. It happened right in front of everyone, and nothing was done about it. Sick world sick system we have . Look at you kids and think , that is the justice we need . No reply by then triggers a formal complaint under CVBR Section 25 and Ontario processes to the Ministry of the Attorney General for systemic infringement of participation/information rights. Justice for Sammy requires real consideration—not dismissal. He is not a back door deal he was my child and was murder in the 1st degree.

The Truth the Court Buried: My Son Sammy Was Murdered—And the System Let It Slide
To the people of Sault Ste. Marie, supporters of Justice for Sammy Jr., families who've lost loved ones to violence, and anyone who still believes in real accountability: I'm letting it out now and more will come. Every single sick detail will be exposed to the world. No more holding back from my family.
My 19-year-old son, Sammy Graham Jr., was murdered on November 12, 2020, outside the Lewis family home on Muriel Drive. Montana Lewis stabbed him twice—deep, forceful wounds full of serious intent. But on January 30, 2026, Superior Court Justice Alexander Kurke ruled manslaughter—not first-degree, not second-degree murder. He called it "close to murder" with a "high degree of culpability." What the f%#kdoes that even mean when the facts scream premeditated killing? It means nothing. The system—the judge, defense (David Bayliss), and the whole process—ignored, twisted, or downplayed the truth to downgrade the charge. Here's what they buried:
1. Two Deep Stabs—Not One "Deliberate Thrust"
Sammy was unarmed. He fought for his life in mere seconds. Pathology and testimony confirmed two penetrating wounds needing significant force:
• One through his left arm (triceps piercing muscle to bone, near the armpit/shoulder area)—a clear defensive wound as he raised his arm to block the knife and protect himself.
• The fatal one to his abdomen, the blade driving through near the rib cage to strike his spine, severing the aorta (the body's largest artery), causing massive, catastrophic blood loss.
Blood was everywhere—pools on the ground, Sammy bleeding out fast, turning blue/grey before help arrived. Yet the judge focused almost entirely on a "single thrust" to the abdomen, barely mentioning the arm wound. The judge even said if it was "over an inch" different, Sammy might have survived. Bullshit. Maybe over an inch more and it cuts 100% through the artery instead of partial (60% or whatever the exact damage was); a bit up and it hits the heart directly. Either way, those stabs were intended to take my son's life—there is no question. Look at the direction of the arm stab: If Sammy hadn't raised his arm to defend himself, that blade was headed straight for his neck or head. But of course, the judge didn't really examine that. Maybe if he wasn't distracted—laughing and giggling with the defense and Crown on several occasions right in front of me and my wife—he wouldn't have missed it. And he missed everything else too. Do you know what that's like for a grieving father? To sit there, watch this disrespect, feel anger at the highest level? Victims of crime are treated with the most disrespect I've ever seen. When we needed the system for the first time ever, you failed us. You failed all victims of crime. Montana knew he was stabbing in a vital area with a very high chance of death. But the judge ignored that fact. The true facts everyone has seen for five years haven't changed. That defensive stab shows real aggression and Sammy's absolute terror in those final moments. Imagine how scared my boy was—not a reflex, not an accident. Sammy likely knocked the knife out after the second stab, explaining why it ended up on the ground.
2. Montana's Lies Everywhere—The Judge Called Them Out, Then Believed What He Wanted
The judge noted Montana had "selective memory" and inconsistencies in almost every statement—from his police interview (no memory) to trial (sudden new details). The Crown challenged his story hard. Witnesses contradicted him: intoxication claims (booze, weed, cocaine) unsupported—Semiah saw no signs, officers reported none. Yet the judge believed Montana's claim that he "released" the knife because he "didn't want to stab anymore." Semiah, right there as eyewitness, testified she never saw any release—she saw the knife on the ground nearby after the attack, amid the blood. She picked it up and threw it aside, then frantically called 911 and tried CPR on Sammy while her brother walked away. Montana started calling his friends, boasting about what he'd done—like a trophy, no remorse, no care. The judge painted and twisted a story that isn't there. We see you all so clearly. I sat there thinking, "You assholes are on the wrong side—what is going on?" But truth is much louder than deception. We have all the facts to show the world what our system is and what you allowed. Montana walked away after murdering my son, told his sister he loved her and said sorry, but he left Sammy to die and left his own sister to watch her boyfriend bleed out. How does the judge credit that part when everything else was unreliable? He contradicts himself and shows himself as unreliable. And if I can remind poepel about trophy Montana first day of pretrial had a nice tear tatoo on his face under his left eye . this is a murder tough in jail, so you know. the judge was told about this but of course this wasn’t talk about
3. Fake "Compassion" After the Stabs—No Real Care
Montana told Semiah "I stabbed him—turn him over." But with Sammy bleeding catastrophically, some how my son "turn himself over". The judge leaned on this as "horror" and "remorse." Montana directed police with a silent point—no words, no urgency. The officer testified it was just a direction, zero real compassion. This from someone who'd texted threats minutes before. He planned this murder. He showed no remorse in court ever for my son death and everyone seen that .
4. Premeditation the System Ignored
Montana had a grudge from the day Semiah and Sammy started dating—like jealous rage always burning. He verbally abused Semiah often (name-calling that day, ongoing mistreatment). Ask Semiah, her mother, Montana himself about Semiah's hospital visit in the first 6 months of her relationship with Sammy—what happened, why she was there, who supported her and made sure she was okay. My son never left her side after that. Don't worry—the truth will all come out. This was planned murder, not just that day or the week before, but far earlier. Sammy walked into this life not knowing who they really were, and Montana had his sights on him immediately. Montana was hard on his sister long before Sammy came into the picture. Sammy wasn't the person she needed protection from—Sammy was the protector, especially from her own family, and Montana hated him for it. Montan sending Texts to friends: “It’s over, he’s done,” “I’m going to kill Sam—today’s the day,” “Sorry Mom, Sam f***ed up and pushed me—it’s his day.” He even got Sammy to look up manslaughter on his phone beforehand—chilling planning. At the station that night, charged with first-degree: Montana's words, "Really? I thought it would be manslaughter." If Sammy hadn't been there protecting Semiah, she might not be here today. And our family would be living a much differenct life This wasn't just rage—it was planned.
The judge (Kurke) dismissed self-defense (fight over, Semiah not threatened), called Montana "childish" and "teenage bravado," but still ruled no intent to kill or plan death. Crown pushed on intent, but it wasn't enough. Defense pushed "reflex," judge denied that. Overwhelming evidence—two stabs, lies, texts, contradictions—downgraded to manslaughter. What?This exposes a broken system: judges, Crowns, defenses that let violent deaths slide with leniency, glossing over key facts, believing killers' selective stories. We're done staying silent. We're releasing every testimony detail, every contradiction, every ignored piece to media, advocates like End Violence Everywhere, and the public. People are uniting—share Sammy's stories (his kindness at Pinewood helping with reading/math, genuine smiles in the East End, holding doors, joking while helping kids with snowshoes). Demand reforms: stronger charges for intent, no more downgrades on premeditated violence.Sammy was murdered. But his light—full of compassion, love, strength and truth—lives on through Sammy's Backpacks, touching kids and reminding us of the good he brought. Our fight for real justice burns brighter because of that love.
This Tribulation has broken our hearts in ways no words can fully capture ever. Every day in that courtroom was torture, not just reliving Sammy's final moments, but watching the system treat victims like us with indifference while we sat there, raw and grieving. Jan 30-2026 the courtroom wasn't evenly split as the are publishing and not getting the true facts once again from my family; it was filled 3/4 with my family, our friends, and people who truly loved and supported Sammy—wearing Justice for Sammy shirts, holding his photo, standing strong for him. Montana's side? Barely there, and it showed. The imbalance spoke volumes: who really cared, who showed up for the boy who was kind to everyone, who helped kids with reading and activities who smiled to the kids that need it the most. For me and my wife Brigette, for our kids, our extended family—this has been five-plus years of sleepless nights, endless tears, rage that boils over, and a grief that never fades. We've cried together, held each other through the nightmares, and leaned on the love we have for one another and for Sammy to keep going. We love each other so deeply; we'd give anything to have him here with us all again, laughing, joking, being the light he always was. But even in this darkness, that love is our strength—it binds us, fuels our fight, and reminds us why we won't stop until the truth is fully heard. Sammy's absence hurts every single day, but our family's unbreakable bond and the compassion he taught us keep us standing tall. It is time for us to all speak the truth. God Bless
