Colleague senators and seven other human rights defenders have taken the Affordable Housing Act to court seeking to quash it in its entirety. We specifically take issue with a section of the new Act that seeks to appoint the Commissioner General of KRA as the collector of the affordable housing levy, and sections 4 and 5 of the Act, which impose the levy. The Commissioner-General of the Kenya Revenue Authority cannot be the collector of Affordable Housing Levy as his responsibilities are strictly restricted to the affairs of the Authority.
Way before we need affordable housing we need affordable water , we can only 3 days without water, and about 20 million of us cannot get (afford) clean drinking water ie the right to life . Is not the housing levy unconstitutional since it takes resources away from water ( right to life) and puts it to a lesser cause ?
