Smith's indictment works EVEN IF the Supreme Court decides that some presidents have immunity for some official acts because the charges are against him as a CANDIDATE for office, not as a sitting president. 2/
Totally agree. Also (because people keep whining about Garland and how long the investigation lasted) it's important to note that a big reason why Smith's indictments will hold up is because the investigation was so thorough and DOJ took the time to litigate issues like attorney client and executive privilege. Had they not done that the indictments would be less detailed and Trump's tactics might have been more effective.
