The SEC's misconduct in Debt Box was not limited to lying about the evidence. The SEC also misrepresented the applicable law. From the Opinion: The SEC "does not acknowledge the existence of on-point, binding Tenth Circuit caselaw that is contrary to its position. In a filing in which the Commission states it takes the “Court’s concerns seriously,” includes a Declaration from the Director of the Division of Enforcement, and repeatedly acknowledges errors and shortcomings it “deeply regrets,” it is difficult to imagine this decision was not knowing. At minimum, this additional breach of the Commission’s duty of candor is at least reckless." p. 73 The Judge is pointing the finger at the top leadership of the organization--the Director of the Division of Enforcement.
@MetaLawMan SMH. We Americans deserve better than what this corrupt and slimy agency has turned into. If there ever was a “Defund” campaign with having it would be Defund the SEC. They need to be dismantled. Completely useless for everyday American investors!!
