Greg Abbott said he was having protesters arrested because “antisemitism won’t be tolerated in Texas.” I believe in arresting people who break the law. But there is no law against antisemitism, and there shouldn’t be.

I’m with you in spirit, but there is no such thing as “hate speech” under our Constitution. Some of the antisemitic speech is not constitutionally protected, such as threats, incitement, intimidation, harassment, and violation of viewpoint neutral time, place, and manner restrictions. Abbott is right to crack down on unprotected speech. Obviously property destruction isn’t even “speech,” but the language of Abbott’s comments should have made clear he did not intend to crack down on protected speech.
