Tomorrow, Thursday, April 25th, we’ve got a big day at SCOTUS: oral arguments on Trump’s presidential immunity claim. But, TODAY, SCOTUS hears oral arguments on whether EMTALA (the Emergency Medical Treatment and Labor Act), which is a federal medical treatment law, supersedes an Idaho law that criminalizes most abortions in that state.
@KatiePhang Thank you, Katie. Yours is one of the first accounts I check in the morning
@KatiePhang Still no ruling on the gag order. This man always gets a pass. It's infuriating.
@KatiePhang How in this world is it a SC issue for women to have access to emergency medical care!?? It’s 2024 for gawd sake!! Unbelievable 😳
I don’t see the relevance between the two laws. EMTALA basically says if someone comes in for an emergency, we need to treat/resuscitate/stabilize whether they can pay for it or . It doesn’t refer to an abortion. If you’re having contractions and your life is in danger, we need to stabilize you. The state abortion law is not in conflict with this law. It’s a waste of SCOTUS time.
@KatiePhang If the main argument for not incarcerating Trump for repeatedly violating the gag order is not disrupting the trial, why not put him in the pokey on Wednesdays and/or weekends?
@KatiePhang Surely the Supreme Court presidential immunity hearing is just an opportunity for the conservative SC judges to delay the DC hearing. It’s not that legally interesting is it?
@KatiePhang So for EMTALA/SCOTUS hearing if the argument goes well will states have to uphold treating pregnant women in emergency situations and the state can not prosecute doctors, and it will be more defined? I mean, if they rule without favor that is a dangerous precedent to set.....
