Motive and intention are two different things. You can establish as a matter of evidentiary fact that someone had a clear motive to do something. Short of a direct confession though, we are not able to read minds and we cannot easily know someone's intentions. We certainly shouldn't be prosecuting people based on our imagined projection of their intentions.
