My email to the electoral office. Hello I would love to address you by your name but you appear to be an unnamed government employee, this will be uncovered in my OIA request.  I have received your letter of 3 July 2026 and seen the statement published on your website the same day. I require this letter and its attachments to be placed before the Chief Electoral Officer and appended in full to the referral provided to the Police. 1. The premise of your referral is wrong. Your letter treats my silence as a refusal to engage. Your emails of 3 June and 17 June 2026 were delivered to the junk mail folder of [email protected] and were never seen by me or my staff. This letter is my response, provided within days of the first correspondence that actually reached me. 2. Answers to your questions, which I would have given on 3 June had your email arrived: (a) I was solely responsible for the production and publication of both statements. (b) They were displayed on a single digital screen at Moorhouse Avenue, Christchurch for a short period of time and have not been displayed since, this predates your first email. The screen space was unrented at the time. No person made or received any payment in respect of the publications. There was no client, no campaign, and no commercial element of any kind. 3. These were not election advertisements. Section 3A(2) of the Electoral Act 1993 excludes "any publication on the Internet, or other electronic medium, of personal political views by an individual who does not make or receive a payment in respect of the publication of those views." Every element is satisfied. A digital screen is an electronic medium on any ordinary reading, and Parliament's words "or other electronic medium" must be given meaning. Section 6 of the New Zealand Bill of Rights Act 1990 requires the interpretation most consistent with the s 14 right to freedom of expression political expression being the most strongly protected speech in a democracy. The same statement published to my social media accounts  which the Commission itself treats as exempt  reaches multi times (10 or more likely) people than the digital screen. The Act protects an individual's unpaid political expression; it does not criminalise the choice of screen. 4. In any event, there was no offence. An illegal practice under s 204F requires a wilful contravention. Both publications carried my full name and that is a fact your own letter concedes. I sought no anonymity; the complainants identified me instantly, which is the entire purpose of s 204F. The display lasted approximately one day and ended before your office made any contact. On any view, this is the paradigm of a matter "so inconsequential that there is no public interest in reporting those facts to the Police" a conclusion your letter says you could not reach only because my answers were missing. They are no longer missing. 5. Your published statement is inaccurate and must be corrected. It asserts the billboards "did not contain promoter statements." Your own referral letter records that they included the statement "Approved by Matthew Horncastle" and lacked only contact details. Publishing the former while knowing the latter materially misrepresents the position to the public and media. I require the statement to be corrected within 5 working days to reflect your own letter's description, failing which I will pursue the matter further, including with the Ombudsman. 6. Future publications. Any future publication I make on this medium will include my name and contact details. For the avoidance of doubt, I do so without prejudice to my position that the Act does not require it, and not as any admission nor future requirement if omitted at anytime if not required. 7. Rights reserved. Should any prosecution be brought, it will be defended in full, including on the grounds above and under the New Zealand Bill of Rights Act 1990, and I reserve all rights, including to seek costs under the Costs in Criminal Cases Act 1967 and in respect of your decisions to refer and to publish. I am confident that a properly directed court would find no offence here. I invite the Commission to convey this letter to Police with the referral, and I invite Police to close the matter. So @nzpolice have taken @BrianTamakiNZ's guns. This retaliatory action by the Firearms Safety Authority, based solely on Tamaki's speech, and without notice, is appalling. One needn't support what he said to oppose the Police's response. Using the 'fit & proper' test to punish firearms licence-holders who are clearly engaging in hyperbole, even unpleasant hyperbole, is wrong. Unfortunately, the Police, working in conjunction with the FSA, have a strong track record of doing exactly this against people who offend them or whom they allege have committed an offence. It doesn't take much to send them down this path. Sadly, it also shows the NZ Police's lack of regard for freedom of speech. A commitment to true freedom of speech allows for even uncomfortable statements that we might not agree with. Once again, the Police have failed. That should concern all NZers, not just those who support Brian Tamaki or who agree with his statements.
