In Feb, 60 Texas State Reps wrote in support of detransitioner @SorenAldaco as SCOTX heard arguments about whether her med mal claims against the providers who harmed her were barred by limitations. Today SCOTX ruled in Soren’s favor: “The Court of Appeals deemed her claims time-barred by the statute of limitations in the Texas Medical Liability Act. We reverse.” Next: as soon as bill filing opens for the 90th Session, I’m refiling HB888/HB1088 to extend the statute of limitations for injured Texans like Soren and I’m grateful to the 60 colleagues—and more—already committed to getting it passed. This is a huge deal. The Texas Supreme Court unanimously overturned the lower court's decision to dismiss Soren's malpractice case. Texas has a 2-year statute of limitations and her case was initially dismissed because lower court said the clock started when her doctors wrote the letter recommending her for mastectomy. Soren's lawyers argued that the clock started when the actual harm occurred - when she underwent surgery to get her breasts removed. Since Texas law defines the 2 year window as starting from "the date of the alleged negligence/wrongful act," Soren's case was obviously consistent with this definition - the "alleged negligent/wrongful act" was surgically removing her breasts. The lower courts' decision was clearly absurd and likely politically motivated. It's crazy this whole thing even had to go to the Texas Supreme Court. But still a huge win.

A jury has awarded Fox Varian a total of $2 million after it found her psychologist and surgeon liable for medical malpractice related to a mastectomy at age 16.

Not only did he give us a platform to share our stories, he fostered dialogue with those of differing opinions—which is crucial for meaningful change and a healthy democracy.
