Oh really? Did centuries of fraud precedent (as well as First Amendment case law) prevent the Justice Department from inventing the wholly novel crime of "fraud against the American people" so Biden's AG could charge his chief political rival? No they did not. Did decades of RICO precedent prevent Fani Willis from turning an organized crime statute against the Trump campaign, including even its lawyers acting under attorney-client privilege? No they did not. Did precedent restrain Alvin Bragg from turning a single bookkeeping misdemeanor into 34 felony charges based on a yet-to-be-disclosed legal theory? No it did not. Wake up. We live in an age of weaponization. The state can and will use every power that you give it against you. And when that happens, you'll be waving around some meaningless opinion letter that you paid a Washington law firm to write while the lawfare radicals laugh at your reverence for precedents they could care less about. They rip down statues of George Washington. You think they care about ripping down a precedent or two? If you give them the power to target American-owned apps and websites (which this bill does), fully expect that they will use it.

@DavidSacks @JTLonsdale It seems based on Joe's latest posts (from legal scholars) the "Bill of Attainder" creates problems if they try and make the bill too narrowly focused on TikTok/Bytedance.
