🔴مذكرة قانونية عاجلة بشأن الوضع الصحي الحرج للسجين السياسي والمدافع الصحراوي عن حقوق الإنسان "النعمة أسفاري" في غياب تطبيق للقانون الدولي الإنساني والقانون الدولي لحقوق الإنسان. ✔️ من منظمة: - تجمع المدافعين الصحراويين عن حقوق الإنسان بالصحراء الغربية (#CODESA) : - لجنة حماية المدنيين الصحراويين ✔️ إلى السيدة: - ميريانا سبولياريتش إيغر (Mirjana Spoljaric Egger) رئيسة اللجنة الدولية للصليب الأحمر (@ICRC) جنيف ـ سويسرا تحية طيبة وبعد، تتشرف منظمة تجمع المدافعين الصحراويين عن حقوق الإنسان بالصحراء الغربية (CODESA) بمخاطبتكم بهذه المذكرة القانونية العاجلة، متوجها إلى لجنتكم الموقرة بصفتها الآلية القانونية والوصية الحصرية على حماية وتطبيق القانون الدولي الإنساني، والجهة الموكل إليها بموجب اتفاقيات جنيف لعام 1949 مراقبة الأوضاع الإنسانية وحماية المدنيين والأسرى في الأقاليم الواقعة تحت الاحتلال. وفي هذا الإطار، نود إثارة انتباهكم القانوني والإنساني الفوري إلى الحالة الصحية الحرجة جداً التي بلغها المدافع الصحراوي عن حقوق الإنسان، النعمة أسفاري (56 سنة)، المعتقل قسرا بالسجن المركزي بالقنيطرة/ المغرب، والذي يخوض إضراباً مفتوحا عن الطعام منذ 8 يونيو/حزيران 2026، مما يضعه حاليا على حافة الموت، ويفرض التزامات قانونية صارمة بموجب القانون الدولي الإنساني تتطلب تدخلكم العاجل. ✓أولاً: التكييف القانوني للوضع في الصحراء الغربية ومسؤولية قوة الاحتلال: بموجب القانون الدولي والقانون الدولي الإنساني (LHI)، وتحديدا اتفاقية جنيف الرابعة لعام 1949 المتعلقة بحماية الأشخاص المدنيين في وقت الحرب، فإن إقليم الصحراء الغربية يصنف كإقليم خاضع للاحتلال العسكري. وبناء على ذلك: 1. تصبح المملكة المغربية قانونياً هي "قوة الاحتلال" الملزمة بالامتثال التام لكافة أحكام ومواد اتفاقية جنيف الرابعة. 2. يعتبر السجناء السياسيين الصحراويين ومن ضمنهم النعمة أسفاري، "أشخاصاً محميين" بموجب المادة 4 من الاتفاقية الرابعة، ولا يجوز تحت أي ظرف حرمانهم من حقوقهم الأساسية أو تعريض حياتهم للخطر. ✓ثانيا: الانتهاكات القانونية المرتكبة بحق السجين " النعمة أسفاري ": إن استمرار احتجاز المدافع عن حقو الإنسان النعمة أسفاري لـمدة تزيد عن 15 عاما (منذ 7 نوفمبر/ تشرين الثاني 2010) تنفيذا لحكم جائر مدته 30 سنة مبني على اعترافات انتزعت تحت التعذيب، يشكل انتهاكا صارخا للمبادئ المستقرة في القانون الدولي: • حظر التعذيب والمعاملة اللاإنساني: تشكل ممارسات التعذيب التي تعرض لها انتهاكاً جسيما للمادة 32 والمادة 147 من اتفاقية جنيف الرابعة، وهي ممارسات ترقى إلى مستوى "جرائم الحرب". • الحرمان من الحق في محاكمة عادل: تمثل محاكمته الصورية انتهاكا للمادة 5 والمادة 66 من الاتفاقية الرابعة التي توجب توفير ضمانات قضائية قطعية للأشخاص المحميين. • جريمة الترحيل القسري (الاختطاف) وتشتيت المعتقلين: يشكل الإبعاد القسري للسجين السياسي "النعمة أسفاري" وباقي رفاقه من مجموعة "أكديم إيزيك" وبقية السجناء السياسيين الصحراويين، وتفريقهم قسرا على عدة سجون داخل أراضي قوة الاحتلال المغربي يعتبر جريمة "نقل قسري" ترقى لمستوى جرائم الحرب. ويعد هذا الإجراء الإقصائي خرقا سافرا لـ المادة 49 من اتفاقية جنيف الرابعة التي تحظر النقل الاجباري للأشخاص المحميين خارج أراضيهم، ولـ المادة 76 التي تلزم باحتجازهم وقضاء عقوباتهم حصرا داخل الإقليم المحتل." • الحق في التواصل مع الأسرة والزيارة الإنسان: إن حرمان زوجته الناشطة الفرنسية كلود مونجان، من زيارته لمدة 8 سنوات متواصلة يعد خرقا فاضحا للمادة 25 والمادة 116 من اتفاقية جنيف الرابعة، واللتين تؤكدان على حق المعتقلين والأشخاص المحميين في استقبال عائلاتهم وتبادل الزيارات معهم. ✓ثالثا: المسؤولية القانونية المباشرة الناتجة عن الإضراب عن الطعام: أمام التدهور المتسارع والخطير للوضع الصحي للنعمة أسفاري نتيجة إضرابه المستمر عن الطعام؛ فإن منظمة تجمع المدافعين الصحراويين عن حقوق الإنسان (CODESA) تؤكد على الآتي من المنظور القانوني الدولي: 1. تُحّل مقتضيات القانون الدولي الإنساني للمملكة المغربية، بوصفها القوة القائمة بالاحتلال، المسؤولية الجنائية والمدنية الكاملة عن السلامة الجسدية والنفسية للسجين السياسي الصحراوي النعمة اسفاري...(البقية في التعاليق) @AmnestyAR @fidh_ar @FrontLineHRD @hrw_ar @UN @UNHumanRights @SidiOmarNY @MaryLawlorhrds @RaftoFoundation @UNGeneva

🔴 استهداف سجينة سياسية صحراوية سابقة رفقة أفراد من عائلتها بالشارع العام. استهدفت مجموعة من ضباط وعناصر شرطة قوة الاحتلال المغربي السجينة السياسية الصحراوية السابقة " #أم_الفضلي_جودا " وابنتيها " #سلم_إبراهيم_الصوفي " و " #مليكة_إبراهيم_الصوفي " في حدود الساعة 10 و 30 دقيقة ليلا بتاريخ 09 تموز / يوليوز 2026 بالشارع العام بالعيون المحتلة . وفي توضيح للسيدة " أم الفضلي جودا " البالغة من العمر 74 سنة ، أكدت أنها فوجئت بضابط الشرطة المدعو " محسن السرغيني " يوقفها ويقوم بتعنيفها وضربها على مستوى اليد والكتف الأيمن والرجل اليسرى ، في وقت قام مساعديه من عناصر الشرطة بزي مدني بالاعتداء على ابنتيها جسديا ولفظيا ، بالتزامن مع وقفة احتجاجية سلمية نظمها مجموعة من الشبان الصحراويين للمطالبة بحق الشعب الصحراوي في تقرير المصير و للتضامن مع السجناء السياسيين الصحراويين . وأضافت هذه الأخيرة بأن هذه الاعتداءات السافرة جرت أمام مرأى ومسمع من مجموعة من المارة من المدنيين الصحراويين ، الذين لولا مساعدتهم لها ولابنتيها لاستمر ضباط وعناصر شرطة قوة الاحتلال المغربي في تعذيبهن وتعنيفهن ، انتقاما من موقفها وأفراد عائلتها من قضية الصحراء الغربية ومن كونها سجينة سياسية صحراوية سابقة كانت قد تعرضت للاعتقال السياسي بتاريخ 09 كانون أول / ديسمبر 2010 وقضت رهن الاعتقال حوالي شهرين معتقلة بالسجن المحلي بالعيون المحتلة قبل أن يفرج عنها مؤقتا رفقة 05 من زميلاتها و مجموعة مكونة من أكثر من 140 سجينا سياسيا كانوا قد تعرضوا للاختطاف و الاعتقال و التعذيب على خلفية مشاركتهم في مخيم " اكديم إزيك " . للتذكير ، فالسجينة السياسية الصحراوية السابقة من مواليد تاريخ 13 نيسان / أبريل 1952 بمدينة كليميم ، سبق لها وعائلتها أن تعرضت عدة مرات للتعذيب و للحصار ولمختلف المضايقات من قبل الأجهزة الاستخباراتية لقوة الاحتلال المغربي. 📍العيون المحتلة بتاريخ : 12 تموز / يوليوز 2026 المكتب التنفيذي لتجمع المدافعين الصحراويين عن حقوق الإنسان بالصحراء الغربية (#CODESA) @amnesty @hrw @fidh_ar @EldhLaw @FrontLineHRD @MaryLawlorhrds @UNHumanRights @europapress @EFEnoticias

🔴Statement of Condemnation and Urgent Appeal : The Europe Section of the Collective of Sahrawi Human Rights Defenders in Western Sahara (#CODESA) expresses its deepest alarm over the catastrophic and life-threatening health condition of Sahrawi human rights defender and political prisoner #El_Naama_Asfari, who has been on an open-ended hunger strike since 8 June 2026 in #Kenitra_Central_Prison, #Morocco As El-Naama Asfari enters the 32nd consecutive day of his #hunger_strike, his health condition has deteriorated to a stage that is beyond dangerous and constitutes an immediate threat to his life. He faces an extremely #high_risk of irreversible organ damage, severe neurological complications, permanent physical disability, and death if urgent action is not taken. Every passing hour without an adequate response further increases the likelihood of irreversible consequences. The #Europe_Section of CODESA holds the #Moroccan_occupying authorities, and in particular the Moroccan General Delegation of the Penitentiaries and Reinsertion Administration (DGAPR), fully and directly #responsible for the life, physical integrity, psychological well-being, and safety of El-Naama Asfari. The continued failure to address his legitimate demands, ensure his protection, and provide appropriate medical monitoring constitutes a grave violation of Morocco's obligations under international human rights law and places full responsibility for any irreversible deterioration or fatal outcome on the Moroccan authorities. The Europe Section recalls that El-Naama Asfari has been arbitrarily imprisoned since the events of Gdeim Izik and has been serving a 30-year prison sentence since 7 November 2010 solely because of his peaceful human rights activism and his defense of the Sahrawi people's right to self-determination. His conviction followed proceedings that have been repeatedly condemned by United Nations human rights mechanisms and international organizations for relying on statements extracted under torture and for failing to meet the minimum guarantees of a fair trial. This visit constitutes an attempt to confer legitimacy upon Morocco’s occupation of Western Sahara , in disregard of the Territory’s internationally recognized legal status. ✔️ CODESA reaffirms that #WesternSahara remains a #Non_Self_Governing Territory undergoing the process of decolonization in accordance with the Charter of the United Nations and the relevant resolutions of the UN General Assembly and Security Council. 🔴Declaración de condena y denuncia : El Colectivo de Defensores Saharauis de los Derechos Humanos en el Sáhara Occidental (CODESA) – Sección de Dajla Ocupada – expresa su más enérgica condena y profunda denuncia por la visita realizada por una delegación de parlamentarios franceses a la ciudad ocupada de Dajla, el sábado 4 de julio de 2026, por invitación y bajo la organización de la potencia ocupante marroquí. Dicha visita constituye un intento de otorgar legitimidad a la ocupación marroquí del Sáhara Occidental, ignorando el estatuto jurídico internacional del territorio. ✔️El Colectivo reafirma que el Sáhara Occidental sigue siendo un Territorio No Autónomo pendiente de descolonización, de conformidad con la Carta de las Naciones Unidas y las resoluciones pertinentes de la Asamblea General y del Consejo de Seguridad de las Naciones Unidas. 🚨LLAMAMIENTO URGENTE: #Salven_la_vida del defensor saharaui de los derechos humanos y preso político #El_Naama_Asfari El Comité para la Protección de los Civiles Saharauis de la Colectividad de Defensores Saharauis de los Derechos Humanos en el Sáhara Occidental (#CODESA) hace un llamamiento urgente e inmediato a las Naciones Unidas, al Comité Internacional de la Cruz Roja (@ICRC) y a todos los mecanismos internacionales competentes para que #intervengan_con_urgencia a fin de salvar la vida del defensor de los derechos humanos y preso político saharaui El-Naama Asfari. 🚨URGENT APPEAL : "#Save the life of Sahrawi human rights defender and political prisoner #El_Naama_Asfari." The Committee for the Protection of Sahrawi Civilians, a branch of the Collective of Sahrawi Human Rights Defenders in Western Sahara (#CODESA), urgently appeals to the United Nations, the International Committee of the Red Cross (@ICRC), and all competent international mechanisms for #immediate_intervention to save the life of Sahrawi human rights defender and political prisoner El-Naama Asfari. Since June 8, 2026, he has been on an openended #hunger_strike in Kenitra Central Prison, Morocco. As El-Naama Asfari enters the 19th consecutive day of his hunger strike, his health is deteriorating severely, posing an imminent threat to his physical and bodily integrity. Consequently, the Committee for the Protection of Sahrawi Civilians of CODESA holds the Moroccan occupying power fully responsible for any dangerous medical, psychological, or neurological repercussions resulting from this strike. The Committee demands urgent mobilization to guarantee his safety and fulfill all his fundamental demands as a prisoner of conscience. (El resto del comunicado) : ....negligencia médica deliberada y traslados arbitrarios a prisiones a cientos de kilómetros de sus familias— forma parte de un sistema represivo sistemático destinado a silenciar las voces que exigen el derecho del pueblo saharaui a la libre determinación. ✅ Registra con profunda preocupación la continua impunidad y la negativa de la potencia ocupante marroquí a abrir una investigación internacional independiente y eficaz sobre las denuncias de tortura presentadas por las víctimas saharauis ante la justicia marroquí o ante los mecanismos competentes de la ONU, a pesar de las claras obligaciones internacionales que exigen una investigación inmediata e imparcial, la rendición de cuentas de los responsables y la indemnización a las víctimas, reparando el daño individual y colectivo de acuerdo con las normas internacionales pertinentes. ✅ Considera que la continuación de estas graves violaciones en un territorio sujeto a ocupación militar y a un proceso de descolonización inacabado obliga al Consejo de Seguridad de la ONU, a las Naciones Unidas, al Comité Internacional de la Cruz Roja, al Alto Comisionado para los Derechos Humanos y a todos los mecanismos internacionales competentes a asumir sus responsabilidades legales y morales para proteger a los civiles saharauis y garantizar el respeto de las normas del derecho internacional humanitario. Declara lo siguiente: 1️⃣ Solidaridad plena e incondicional con todas las víctimas de la tortura en el mundo, y con todas las víctimas saharauis civiles de la tortura y sus familias, perseguidas debido a sus opiniones y posturas sobre la cuestión del Sáhara Occidental. 2️⃣ Firme condena de la práctica continua de la tortura, los malos tratos, la desaparición forzada y la detención arbitraria en la parte ocupada del Sáhara Occidental. 3️⃣ Exigencia de la creación de un mecanismo internacional independiente y permanente para vigilar la situación de los derechos humanos en el Sáhara Occidental e investigar lo que los defensores de los derechos humanos, los presos políticos y los civiles saharauis han sufrido y sufren, incluida la tortura física y psicológica que provocó la muerte de muchos de ellos dentro de escondites secretos, cuarteles militares y múltiples centros de detención. 4️⃣ Llamamiento al Comité Internacional contra la Tortura, a los Relatores Especiales sobre la tortura, la detención arbitraria y los defensores de los derechos humanos para que intensifiquen su seguimiento de la situación de los derechos humanos en el territorio. 5️⃣ Liberación inmediata e incondicional de todos los presos políticos saharauis, garantizando sus derechos fundamentales, incluido el de reunirse con sus familias, y trabajando en su compensación material y moral, basándose en la recomendación del Grupo de Trabajo de la ONU sobre la Detención Arbitraia en favor de un grupo de estudiantes y presos políticos saharauis contra los que se dictaron sentencias ilegales a raíz del caso de Gdeim Izik. 6️⃣ Adhesión al principio de no impunidad y rendición de cuentas de todos los funcionarios implicados en delitos de tortura y crímenes de lesa humanidad cometidos contra civiles saharauis. 7️⃣ Insistencia en que la protección del pueblo saharaui contra la tortura y las violaciones graves es inseparable de la posibilidad de ejercer su derecho inalienable a la libre determinación, de conformidad con la Carta de las Naciones Unidas y las resoluciones pertinentes de la Asamblea General y del Consejo de Seguridad. 8️⃣8 Llamamiento a la comunidad internacional para que actúe urgentemente a fin de poner fin a las continuas violaciones del derecho internacional humanitario y del derecho internacional de los derechos humanos en el Sáhara Occidental. 📍El Aaiún Ocupado, Fecha: 26 de junio de 2026 Buró Ejecutivo del Colectivo de Defensores Saharauis de los Derechos Humanos en el Sáhara Occidental (#CODESA)

🔴 Declaración con motivo del #Día_Internacional_en_Apoyo_de_las_Víctimas_de_la_Tortura. Los países del mundo conmemoran el 26 de junio de cada año el Día Internacional en Apoyo de las Víctimas de la Tortura, establecido por la Asamblea General de las Naciones Unidas para conmemorar la entrada en vigor en 1987 de la Convención contra la Tortura y Otros Tratos o Penas Crueles, Inhumanos o Degradantes, y para renovar el compromiso internacional absoluto de prohibir la tortura por considerarla uno de los crímenes más graves que atentan contra la dignidad humana y una violación flagrante del derecho internacional. La práctica continua de la tortura en la parte ocupada del #SáharaOccidental constituye una violación de la Convención contra la Tortura, por un lado, y una grave infracción de las normas del derecho internacional humanitario y del derecho internacional de los derechos humanos, por otro. Así lo han expresado numerosas organizaciones internacionales de derechos humanos y órganos de la @ONU_es, como la Oficina del Alto Comisionado de las Naciones Unidas para los Derechos Humanos, que en 2006 vinculó la continua comisión de diversas violaciones graves de los derechos humanos en el Sáhara Occidental con la confiscación del derecho del #pueblo_saharaui a la libre determinación. Con este motivo, el Colectivo de Defensores Saharauis de los Derechos Humanos en el Sáhara Occidental (#CODESA) recuerda la situación de las víctimas saharauis que, desde la invasión militar de las fuerzas de ocupación marroquíes en el Sáhara Occidental en 1975, han sido sometidas a múltiples formas de tortura, desaparición forzada, detención arbitraria y castigo colectivo, en relación con la cuestión del Sáhara Occidental, calificada por la Asamblea General de la ONU como cuestión de descolonización desde 1963. Considerando que el Día Internacional en Apoyo de las Víctimas de la Tortura no es sólo una ocasión para el recuerdo, sino un llamamiento mundial a la verdad, la justicia y la reparación, y para poner fin definitivamente a las políticas de opresión e impunidad, permitiendo a los pueblos sometidos a la ocupación alcanzar sus derechos fundamentales, principalmente el derecho a la libertad y a la #autodeterminación; Y al recordar el Colectivo que la prohibición de la tortura es una norma imperativa de derecho internacional conocida como (#JusCogens), que no puede ser derogada ni restringida bajo ninguna circunstancia, se fundamenta en: ✔️ El Artículo (5) de la Declaración Universal de los Derechos Humanos, que establece: "Nadie será sometido a torturas ni a penas o tratos crueles, inhumanos o degradantes". ✔️ El Artículo (7) del Pacto Internacional de Derechos Civiles y Políticos. ✔️ Los Artículos (1), (2), (4), (12), (13) y (14) de la Convención contra la Tortura. ✔️ El Artículo 3 común a los cuatro Convenios de Ginebra de 1949, que prohíbe los atentados contra la vida y la integridad corporal, especialmente la tortura y los tratos crueles. ✔️ El Artículo (75) del Protocolo Adicional I de 1977, que prohíbe la tortura y los tratos degradantes. ✔️ El Artículo (7) del Estatuto de Roma de la Corte Penal Internacional, que considera la tortura, cuando se comete como parte de un ataque generalizado o sistemático contra una población civil, un crimen de lesa humanidad. ✔️ El Artículo (8) del mismo Estatuto, que considera la tortura un crimen de guerra en los conflictos armados.
