NEW: @NBCNews reporting an Afghan on the FBI terror watchlist has spent almost a year in the U.S. after he was caught & released by Border Patrol at the California border in March 2023. NBC reports the watchlist shows he is a member of Hezb-e-Islami, a U.S. designated terrorist group responsible for the deaths of at least nine American soldiers and civilians in Afghanistan. NBC reports that in February, the FBI tipped off ICE that he may be a national security threat, and ICE later arrested him in San Antonio, TX. He was held in ICE detention until his court hearing two weeks ago, when a federal immigration judge ordered he be released on bond, despite ICE prosecutors arguing he’s a flight risk. UPDATE: Multiple senior DHS officials tell me & @GriffJenkins that the Afghan was not on the terror watchlist when he was arrested at the border last year, and that Border Patrol didn’t release him, he was referred to ICE and ICE released him on ATD (alternatives to detention). 11 months later, in February 2024, he was officially added to the FBI terror watchlist after new “concerning” information was developed on him, ICE was notified, and ICE arrested him in San Antonio, we are told. Colleague @davidspunt, who covers DOJ, says per a source familiar, during the Afghan man’s court hearing two weeks ago, DHS prosecutors did not tell the federal immigration judge that the Afghan was on the terror watchlist or a possible national threat, only arguing that he was a possible flight risk. The judge ordered him released on bond. We pressed the senior DHS officials on this, they told us it is inaccurate to say they didn’t argue against his release, but they would not confirm or deny not telling the judge he was on the terror watchlist, telling us that they cannot disclose what they do or don’t say in court, and that they are limited by what they can tell a judge. The DHS officials said they aren’t happy with the judge’s decision, and they disagree with it. Fox is told DHS has not appealed the judge’s decision yet. Bottom line - this Afghan on the terror watchlist is now in the wind, free to roam the country until his next court date in 2025, at least for now.
