This is more or less a simple legal issue. The contract has been entered and must be honored, “pacta sunt servanda” (every contract must be kept). In fact the 150 bags of cement are no longer that is the vendor and he cannot sell those goods already paid for. The buyer is entitled to the 150 bags without additional fees attached to the goods (even when the market value has changed). The case of BILANTE INTERNATIONAL LTD v. NDIC (2011) is very instructive here, where the Supreme Court held that parties are bound by their terms of their agreement and court will not rewrite contracts for parties. However, the only reasonable demand from the seller is to ask for reasonable fees for keeping the goods for the buyer for that 4 months and nothing more. The seller demands in this instance is mischievous and unreasonable. This case whether real or hypothetical represents what Nigeria business people always do, they try to use every means to extort their customers.
