“squatter’s rights” is basically because well meaning lawyers got good tenant protections passed (your landlord shouldn’t be able to just assert you’re a squatter and kick you out), didn’t really think through that the court systems take forever to resolve these cases, and so created a situation where some bad actors figured out they could squat on a property and run out the clock while living rent free and this is the story of many many many things in America
political system dominated by lawyers funnels everything through the legal process and then we are surprised when bad actors (who are frankly more often on the landlord side of the equation) take advantage of the arduousness of that process to nakedly abuse the law
But also like the way to avoid these “squatter’s rights” scenarios is to have a rental registry where leases are recorded with the government, but guess who is the biggest opponent of those??? that’s right, LANDLORDS
Folks all the media stories you are seeing about “squatter’s rights” are not actually about adverse possession
@ArmandDoma Where are landlords opposing a lease registry? Post one legitimate link with any substance
@ArmandDoma The solution for overbearing government regulation? More government regulation!
@ArmandDoma What about a voluntary registry where it's up to the landlord to file or not? No file, no protection.
@ArmandDoma Ah that explains the discourse If this had been in Romania, where we have that, I'd have sided with the squatters because it would have been more likely the landlord just tried to dodge taxes by not registering the rental.
@ArmandDoma So why were/are they going after the mayor? Is this about landlords or the government not working like it should?
@ArmandDoma I get it, but lamenting overlegalization while saying the solution is, like, you have to file a UCC form to perfect your lease and if you don’t tenant protections don’t apply?
@ArmandDoma All of this gets solved with a real estate and rental blockchain! Immutable proof of ownership that can be used for all sorts of things (utilities, taxes, emergency services….)
@ArmandDoma I wish people would learn that developers != landlords, developers are useful bc they build more housing, and landlords are the enemy
