I'm going to write another article on the outcome here which will be more of a deep dive on the Majority Opinion and Justice Sotomayor's dissent. There are some questions being debated about just how far the opinion reaches down into the bureaucracy, and whether there remains some level of independence for the ranks of the "career bureaucrat staff" that carries over from Administration to Administration, with them not being subject to at will termination in the same way the "Principal Officers" who are appointed to head up the independent agencies now are. But that's going to take more time than I had available since the Court began dropping its final decisions of the term last week.

In 2001 SCOTUS held - a 5-4 vote - in Zadvydas v. Davis that illegal aliens have "due process" rights, but avoided saying those rights included a bond hearing that could lead to release from detention. Next fall it will hear a new case that might reverse that. Link below.
