Just stumbled across this Second Circuit footnote addressing (and rejecting) the court's prior suggestion in dicta that a tension exists between diversity jurisdiction and certifying state-law issues to state courts. An interesting question.

Terrible writing thing: complaining that an appellant "rehashes the same arguments raised below." Well yes, obviously. That's what an appeal is. Imagine you hashed a whole bunch of new arguments! #AppellateTwitter.

It is truly amazing how well CaseText's natural language searching works. Like, you can just type in "putting one's hands in one's pockets on a chilly day is not suspicious," and you'll actually get helpful cases.
"It's not that I don't get it," I say, while not getting it. "It's just the JUDGES are generalists, and I'll need to explain it to them."
This is also why being an appellate lawyer rules. (Did I send an email asking for a chemistry whiz with a great deal of patience to talk to me today? Why yes, I did.)
I certainly understand this view, but it does put later parties at the mercy of what can often be very bad lawyering of those who come before.

@nyttypos Only in extremely limited situations. For example, it's contradicted by objective documentary evidence that no reasonable factfinder could disbelieve. Or it contradicts the party's own prior testimony. It's not a generally applicable rule.
Five years ago today, crossing the street to argue at SCOTUS. I hardly remember the argument but I will never forget the friends and colleagues who supported me along the way. #appellatetwitter
